Federal antitrust lawsuit could affect Colorado physicians’ out-of-network payments

A federal antitrust lawsuit has been filed against MultiPlan, which recently changed its name to Claritev, and several major health insurance companies, including UnitedHealth, Elevance (Anthem), Humana, Aetna, Cigna, and various Blue Cross Blue Shield organizations. The suit alleges that these companies engaged in a coordinated price-fixing scheme to keep out-of-network payment rates low.

According to the lawsuit, insurers used MultiPlan’s pricing systems—operating under names such as Data iSight, Viant, NCN, ProPricer, and MARS—to standardize payments at levels below what would be expected in a competitive market. This practice may have resulted in lower payments for physicians and healthcare facilities across the country. Many practices in Colorado could have had claims repriced through these systems without their knowledge.

The case has moved forward after significant developments. In March 2025, the U.S. Department of Justice filed a statement of interest in the matter. Then in June 2025, a federal court denied a motion by the defendants to dismiss the case. These actions indicate that federal authorities view the allegations as serious and deserving of further examination.

Physicians and healthcare providers who received out-of-network payments from these insurers may be eligible to seek financial damages for claims up to ten years old. The court has appointed attorneys to handle individual claims apart from any class action process. Providers can pursue recovery now rather than waiting for a class action decision; however, certification of a proposed class action is not expected until 2027.

The Colorado Medical Society stated: “CMS is sharing this information as part of our ongoing commitment to defending the economic viability of physician practices and pushing back against unfair payer practices. Whether through advocacy at the Capitol, regulatory reform, or monitoring high-impact litigation like this, CMS works to ensure physicians have the information and support they need to protect their practices.”
